A Wrongful death action is an action brought on behalf of an individual who died as the result of someone’s fault. When should I hire an attorney for a wrongful death case?
There are very short time frames in some wrongful death cases. If your loved one was injured or killed because of the actions of any state or local government, you need to give a special notice which is called the Governmental Immunity Act. Most people refer to it as the GIA notice. This notice is required to be made within 182 days of the wrongful act. If you don’t send the proper contents in the GIA notice and to the proper entities, no matter how great your case may be you may not be able to bring a claim at all. Generally wrongful death claims have a two-year statute limitations. There are exceptions to this rule. For example, if you are bringing a lawsuit against a liquor establishment or bar for over serving someone, which is also known as the Dram Shop Act, there is a one year statute limitations.What happens if after investigating a case, it is determined that I should not proceed with the claim?
