THERE ARE VERY SHORT TIME LIMITS THAT YOU MUST MEET IN ORDER TO RECOVER FROM THE RESPONSIBLE PERSON/COMPANY OR ORGANIZATION. If the death occurred due to the acts or negligence of the government, you must give notice to that governmental agency within 182 days (C.R.S. 24-10-109). In fact, we successfully argued in front of the Court of Appeals issues on notice to the Government. If the wrongful death involves liability of liquor establishments or the serving of alcohol, you must file your suit within one year of the death.

In wrongful death cases, the surviving spouse, children, parents or estate may be entitled to monetary damages for loss of companionship, loss of earning potential, funeral expenses and the like. There are many reasons why wrongful death cases occur including, but not limited to, car accidents, acts of government or intentional actions like assault and battery.
It is important for you to immediately contact the attorneys at Harding & Associates so that we can start to preserve evidence, commence an immediate investigation of the accident that caused the death and make sure that all time frames for filing a lawsuit or notice are strictly adhered to. If you miss these important dates, this could mean you will not recover any damages/compensation — no matter how good your case is.
Wrongful Death FAQWhen should I hire an attorney for a wrongful death case? There are very short time frames in some wrongful death cases. If your loved one was injured or killed because of the actions of any state or local government, you need to give a special notice which is called the Governmental Immunity Act. Most people refer to it as the GIA notice. This notice is required to be made within 182 days of the wrongful act. If you don’t send the proper contents in the GIA notice and to the proper entities, no matter how great your case may be you may not be able to bring a claim at all. Generally wrongful death claims have a two-year statute limitations. There are exceptions to this rule. For example, if you are bringing a lawsuit against a liquor establishment or bar for over serving someone, which is also known as the Dram Shop Act, there is a one year statute limitations. What happens if after investigating a case, it is determined that I should not proceed with the claim? The contingency fee from my firm specifically says that in less after paying out the attorney’s fees and cost the client does not net a recovery, you owe my firm nothing. That means if after investigating a potential wrongful death claim we determine that there is not a claim to be made you do not owe my firm a dime. This ensures that after the loss of a loved one you will not be burdened with any attorney’s fees or cost from my firm.

Secondly, their offices are in one of THE most amazing buildings in Denver. A trip there is a lesson in Denver history. There are personal injury attorneys in modern sleek offices and they wear fancy suits - problem is, they're mostly 'fancy' and high pressure.
This team is kind, professional, knowledgeable and efficient. My outcome was amazing and the settlement was more than I realized it could be.
